Utah Car Insurance Coverage and Rates

An insurance policy should be as unique as your vehicle; your insurance policy rate is often based on what kind of coverage you have.

But first, let’s go over Utah’s car culture. This will help you better understand Utah’s car insurance laws.
Utah’s Car Culture
Much of Utah’s car culture begins with the Mormon pioneers who moved to Utah back in 1847.
According to the Hartford, after Utah became a state in 1896, various groups of people with their own reasons to head West continued to traverse its sometimes otherworldly terrain, despite the challenges it presented.
Some of these historic routes through Utah history can still be followed to this day – by car, of course.
Several National Historic Trails wind through the state, commemorating the Pony Express, the expansion of train service across the nation, the travels of the early Mormons, and the trek to California in search of gold.
Utah’s Minimum Car Insurance Requirements
Just like 47 other states in the U.S., Utah requires every driver to carry a car insurance policy. However, Utah is one of a dozen or so states considered to be a no-fault car accident state.
What is a no-fault car accident state?
According to NOLO, a no-fault car insurance state means that if you cause an accident and involve another driver, you are not technically required to pay for damages and/or medical intervention resulting from that accident.
Under no-fault, after a car accident, your own car insurance coverage (in Utah, that means your “personal injury protection” coverage) pays for medical treatment and other out-of-pocket losses incurred by anyone covered under the policy, up to coverage limits, regardless of who caused the accident.
But with a no-fault claim, you can’t get compensation for your “pain and suffering” and other non-monetary damages stemming from the accident.
But what does all this have to do with insurance?
The state of Utah has a minimum liability insurance law.
What does liability insurance cover?
Liability insurance is usually a safety net type of insurance. If you get into a car accident, vehicle repairs can cost thousands of dollars and not everyone has that kind of money just lying around.
Liability insurance is there to help you cover these costs, but keep in mind that having liability insurance may not cover every cost resulting from an accident. That’s why having more insurance is always better.
Utah’s minimum liability insurance requirements are:
- $3,000 in personal injury protection coverage
- $25,000 in liability coverage, per person, for bodily injury after an accident you cause
- $65,000 total liability coverage per accident, when more than one person suffers bodily injury after an accident you cause
- $15,000 per accident for property damage you cause in a car accident

Forms of Financial Responsibility
What is a form of financial responsibility? This is just a fancy term for proof of insurance. All drivers are required to show proof of insurance, license and registration every time a law enforcement officer requests to see it.
Acceptable forms of insurance are:
- Valid liability insurance ID cards
- Copy of your current car’s insurance policy
- Valid insurance binder (a temporary form of car insurance)
- Picture proof of insurance on your smartphone
- Electronic proof of insurance
According to the Utah State Legislature, Utah has an insurance monitoring system that can verify if you have let your insurance policy lapse in the last three months.
If your lapsed policy appears in the Utah database, the DPS will send you a notice which you must reply to with an attachment of your proof of insurance within 15 days.
What happens if you fail to show a form of financial responsibility?
Drivers who fail to provide proof of insurance are subject to a $400 fine plus $50 surcharge on your first offense, and $1,000 plus $50 surcharge on your second and subsequent offenses.
If you’re caught driving without proof of insurance a second time, you may have your license suspended until you can provide the correct documents.
Insurance can sometimes cost you less than $1000 per year — so there’s no reason to risk driving without proof of insurance or an insurance policy.
Premiums as a Percentage of Income
In 2014, Utah’s average per capita disposable income was $33,566. This is the amount of money a person takes home after paying taxes.
When you break this down monthly, Utah residents have about $2700 to spend on groceries, living expenses, and insurance every month.
But what exactly do Utah residents spend a year on car insurance alone?
A full coverage insurance policy cost $852.66 a year in 2014. This means Utah drivers spend an average of 2.54 percent of their per capita salary a year on car insurance alone.
The same year, countrywide, Americans had an average per capita income of $40,859 and spent $981.77 per year on a full coverage car insurance policy.
When we look at surrounding states, Colorado had a higher per capita income of $43,609 and Colorado drivers paid an average of $939.52 for car insurance.
Idaho had a much lower per capita income of $33,600 and paid an average of $673.13 per year on a full coverage policy.
Over the span of three years from 2012-2014, Utah residents saw an average income increase of about $1500. Insurance costs increased by about $47.

What happens if you get hit by an uninsured driver and you want to sue them for damages? Chances are, you’ll never see any of that money because that uninsured driver will likely go bankrupt trying to pay for repairs and medical bills.

Loss ratio percentages how we can see how many filed claims were paid and how many filed claims were unpaid. But why is this important?
If a company has a loss ratio percentage that is too high (over 100 percent) then the company could be at risk of going bankrupt because it has paid too many claims – some of which may have been fraudulent.
On the other hand, if a company has a super low ratio (under 50 percent) then the insurance company may be scamming you as well we other clients.
This is bad for insurance company clients because they have a 50 percent chance or less of their claim being paid. Ouch.
If you look at the table above, the medical payments loss ratio percentage is well over 100 percent – in fact, it was at 171 percent in 2014. This means that 171 percent of filed claims were paid out. This is no bueno.
So, what should you look for when interviewing new car insurance companies? Find a company with a loss ratio percentage between 50-100 percent.

Utah’s Car Insurance Companies with the Best Ratings
In April 2019, J.D. Power conducted a study in order to rank car insurance companies based on five customer satisfaction factors: interaction; policy offerings; price; billing process and policy information; and claims.
The study is based on responses from 42,759 auto insurance customers and was fielded from February through April 2019.
With the exception of USAA (a company that only serves military members and their families), the Hartford was the highest-ranked car insurance company in Utah.

Utah Car Insurance Laws
We can talk about car insurance laws all day long, but at the end of the day, it’s important to know how those laws are formed and who creates them.
State laws are created a few different ways, but according to the NAIC, Utah uses what’s called a use and file system. You can read more about this at the Utah Department of Administrative Services.
Windshield Coverage
Unfortunately for Utah drivers, insurance companies aren’t required by law to replace a broken windshield, however insurance companies may offer windshield repair with a comprehensive plan.
Some laws to consider when purchasing windshield insurance are:
- Insurers may use “aftermarket crash parts” (“nonmechanical sheet metal or plastic parts”) but must disclose that they are doing so.
- You have the right to use a repair shop of your choice but may have to pay the difference.
High-Risk Insurance

If you have been involved in an accident, been charged with a DUI, reckless driving, or a speeding ticket, you might find it to be difficult to get regular Utah auto insurance because you’ll be considered a high-risk driver.
In Utah, if you are a high-risk driver, you might be eligible for Utah’s high-risk insurance plan, called the Utah Automobile Insurance Plan (UT AIP).
Utah Auto insurance high-risk selection is the process by which vehicle insurers determine whether or not to insure an individual and what insurance premium to charge.
Depending on the jurisdiction, the insurance premium can be either mandated by the government or determined by the insurance company in accordance with a framework of regulations set by the government.
Often, the insurer will have more freedom to set the price on physical damage coverages than on mandatory liability coverages.
When the premium is not mandated by the government, it is usually derived from the calculations of an actuary based on statistical data. The premium can vary depending on many factors that are believed to have an impact on the expected cost of future claims.
Keep in mind that high-risk drivers are not allowed to choose their insurance provider.
To qualify for the UT AIP program, you must do the following:
- Submit an application stating that you have tried to secure insurance through the voluntary insurance market during the past 60 days
- Provide a valid driver’s license
- Have a vehicle registered in Utah
Drivers insured through Utah’s high-risk plan have a few different options to pay their premiums.
You can opt to put 40 percent of your annual premium down as a deposit when you send in your application, and pay the remaining 60 percent within 30 days of your policy being issued.
Low-Cost Insurance Program
Unfortunately, Utah does not currently have a government-assisted insurance program for families with low income.
California, Hawaii, and New Jersey are the only three states in the U.S. that provide car insurance to low-income families.

What is automobile insurance fraud?

According to the IIHS, insurance fraud can be “hard” or “soft.” Hard fraud occurs when someone deliberately fabricates claims or fakes an accident.
Soft insurance fraud, also known as opportunistic fraud, occurs when people pad legitimate claims, for example, or, in the case of business owners, list fewer employees or misrepresent the work they do to pay lower premiums for worker’s compensation.
The IIHS also says that the Insurance Research Council reported that “Auto insurance fraud and claim buildup added between $4.9 billion and $6.8 billion to closed auto injury claim payments in 2007.”
Insurance fraud is a crime in the state of Utah. If you are caught committing insurance fraud, you could be charged with some serious jail time and have to pay a hefty fine.

Statute of Limitations
The statute of limitations law is set in place to protect both the driver and the insurance company. To help insurance companies stay in business, Utah has a law stating that drivers only have a certain amount of time to file a claim after an accident.
To help drivers get the insurance money they deserve, this law provides ample time to file a claim.
According to the Utah State Legislature, drivers have four years to file a personal injury claim and three years to file a property damage claim.
Keep in mind that the clock starts ticking to file a claim the second you get into a car accident. Don’t wait to file those claims. Years go by faster than you think.
Utah State-Specific Laws
Utah has a couple of funky laws, and we thought we’d include them in this next section below as described by the Utah State Legislature.
In Utah, any person owning or operating a nonresident off-highway vehicle who operates or gives another person permission to operate the nonresident off-highway vehicle on any public land, trail, street, or highway in this state shall:
- apply for an off-highway vehicle decal issued exclusively for an off-highway vehicle owned by a nonresident of the state
- pay an annual off-highway vehicle user fee
- provide evidence that the owner is a nonresident
There’s a bill stating that purchasing tier-three gasoline is preferred.
The Transportation of Veterans to Memorials bill says:
- creates a support special group license plate to support programs to transport
veterans to Washington D.C. to visit veterans memorials - creates a restricted account to receive funds and facilitate distribution

Vehicle Licensing Laws
Have you ever heard of a REAL ID?
By October 2020, Utah residents will need to carry a real I.D. with the star in the upper right-hand corner if they wish to go through airport security and board a domestic flight.
Keep in mind that you will not need to carry a real I.D. to drive or vote.
Penalties for Driving Without Insurance
You should know by now that it is illegal to drive without insurance in the state of Utah. But what if you get caught driving without insurance?

If you drive without insurance, your license may be suspended and you’ll most likely have to pay a fine of $400 or more.
But let’s go back to the beginning. What are some acceptable forms of proof of insurance?

- Valid insurance binder (a temporary form of car insurance)
- Picture of proof of insurance on your smartphone
- Electronic proof of insurance
If you are pulled over by a law enforcement officer, you must be able to show proof of insurance, license, and registration.
It’s never cheaper to skip out on car insurance. If you get into an accident and you don’t have the cash to cover the costs of damages and medical bills which resulted from that accident, you may wind up bankrupt.
Teen Driver Laws
In Utah, teens may apply for a driving permit at only 15 years old. Look at the table below for more laws about teen driving.

According to the IIHS, permit holders younger than 18 may only drive under the supervision of a driving instructor, a parent or guardian, or a responsible adult who has accepted liability for the permit holder’s driving by signing the permit application.
Permit applicants younger than 19 must be enrolled in driver education.
Supervised driving in the learner stage may include up to five hours in a driving simulator. License applicants who are younger than 19 must have completed driver education.
There are also restrictions for drivers with restricted licenses.

Driver License Renewal Procedures
It doesn’t matter if you’re 18 years old or 80 years old – all Utah drivers must renew license every eight years.
Drivers may renew licenses online for every other renewal.
Drivers 64 years old and younger must provide proof of adequate vision when renewing a license in person; drivers 65 years and older must provide proof of adequate vision at every renewal.
New Residents
If you are new to the state of Utah, welcome. New residents to Utah are allowed 60 days to transfer titles and registrations. To do this, you will need the existing title (unless held by a lien holder as collateral in a financing agreement) and the most recent registration.
According to the Utah DMV, all vehicles that are titled or registered in Utah for the first time are required to complete a Vehicle Identification Number (VIN) inspection.
If you are a new resident, you also need to make sure you contact your current insurance provider and ask them to switch your policy over to comply with Utah’s insurance requirements.
To refresh your memory, Utah’s minimum liability insurance requirements are:
- $3,000 in personal injury protection coverage
- $25,000 in liability coverage, per person, for bodily injury after an accident you cause
- $65,000 total liability coverage per accident, when more than one person suffers bodily injury after an accident you cause
- $15,000 per accident for property damage you cause in a car accident
Keep in mind that some insurance providers do not have coverage in all 50 United States.
Negligent Operator Treatment System (NOTS)
According to Nolo, negligent or “reckless” driving is a crime in Utah. A person can be convicted for:
- driving in a “willful or wanton disregard for the safety of persons or property”
- by committing three separate moving violations within a continuous three miles of driving
What are the penalties of reckless driving?
Reckless driving is a class B misdemeanor in Utah. Convicted motorists face up to six months in jail and a maximum of $1,000 in fines.
For a first reckless driving conviction, the Driver License Division (DLD) can suspend the driver’s license for up to three months upon the recommendation of the judge.
License suspension is mandatory for a second reckless driving violation within a 12-month period.
A reckless driving conviction will add 80 demerit points to the motorist’s driving record. Generally, accumulating 200 or more points within a three-year period can lead to license suspension.
In some states, it’s possible for a driver who’s charged with a DUI, to “plea bargain” for a lesser charge. When a DUI is plea-bargained down to a reckless driving charge, it’s sometimes called a “wet reckless.”
Utah law doesn’t prohibit plea bargaining in DUI cases. So, for someone who’s accused of driving under the influence in Utah, plea bargaining for a reckless driving charge is a possibility.
Utah Rules of the Road
Not knowing the rules of the road can land you a ticket, and/or put you in an accident which always results in an increase in your insurance rate. In this next section, we will cover some important rules of the road.
We’ll hit topics like seat belt laws, speed limit laws, automation on the road and more.
Fault and No-Fault
As we previously discussed, Utah is a no-fault car accident state.
Nolo says that under no-fault, after a car accident, your own car insurance coverage (in Utah, that means your “personal injury protection” coverage) pays for medical treatment.
Other out-of-pocket losses incurred by anyone covered under the policy, up to coverage limits, regardless of who caused the accident.
Utah requires at least $3,000 in no-fault (known as “personal injury protection” or “PIP”) coverage.
According to the Utah Division of Motor Vehicles, no-fault insurance must be continuously maintained on all passenger vehicles (cars and trucks) throughout the vehicle’s registration period if:
- the vehicle’s owner/operator is a Utah resident, or
- the vehicle’s owner/operator is a non-resident of the state who operates a vehicle that has been physically present in Utah for 90 days during the last 365 days (in this situation, the non-resident owner must maintain no-fault insurance while the vehicle remains in the state).
It’s important to note that Utah’s no-fault car insurance system applies to injuries caused by car accidents, but not to vehicle damage claims. A claim for damage to (or total loss of) a vehicle can be made against the at-fault driver in Utah, with no limitations.
Seat Belt and Car Seat Laws
Are you aware of Utah’s seat belt and car seat laws? Utah wants its drivers to be safe while on the road, so pay attention and buckle up as we truck through this next section.

Break one of these laws and you’re looking at paying a fine of $45 plus fees.
According to AAA, except for employees on duty, riding in the cargo area of a pickup truck is not permitted.
Keep Right and Move Over Laws
In Utah, you’re supposed to move right if you are blocking traffic in the left lane. If you’re traveling at a slower speed than normal, move right to allow faster traffic to pass.
According to the AAA, State law requires drivers approaching a stationary authorized emergency vehicle, tow truck or highway maintenance vehicle displaying flashing lights, and traveling in the same direction, to reduce speed and, if safe to do so, vacate the lane closest to stationary vehicles.
Speed Limit Laws
Listed below are the maximum speed limits for the state of Utah.

In Utah, the speed limit may be increased beyond 75 mph on any freeway or limited access highway on the basis of an engineering and traffic investigation. The highest posted limit in Utah is currently 80 mph.

Automation on the Road
So what in the world is automation on the road?

In driving, automation involves using radar, camera, and other sensors to perform parts or all of the driving tasks on a sustained basis instead of the driver.
One example is adaptive cruise control, which continually adjusts the vehicle’s speed to maintain a set minimum following distance.
Features such as automatic braking, which acts as a back-up if the human driver fails to brake, or blind-spot detection, which provides additional information to the driver, aren’t considered automation under this definition.
Currently, Utah is in the vehicle automation deployment stage.
This means that right now, there are automatic vehicles that do not require an operator to be inside the vehicle on the road in Utah. However, the operator must be licensed by the state of Utah and operators must have insurance.
Safety Laws in Utah
Let’s talk about safety. This next section won’t be as long, but it’s just as important.
To be short and to the point, we want to cover DUI laws and penalties, distracted driving laws and impaired driving laws. First, we’ll discuss drinking and driving statistics.
DUI Laws
From 2008-2017, there were a total of 468 alcohol-impaired traffic fatalities on the roads in Utah. Fifty-three of those deaths happened in 2017 alone. Take a look at some of these DUI laws below.

The penalties for a fourth offense are the same as those for a third offense. Hopefully, you’re never in one of these situations, but if you are, just know that these penalties are enough to end your driving independence for a good, long while.
Marijuana-Impaired Driving Laws
There is a zero-tolerance law for THC and metabolites in the state of Utah. If you’re caught with marijuana in your system at all, you could be facing jail time and you may even be stuck paying all kinds of fines.
Don’t drink and drive, and don’t do drugs — especially while you’re driving.
Distracted Driving Laws
If you are 18 or younger, it is illegal to use your cell phone for anything while driving. Texting and driving is completely illegal in the state of Utah.

Road Fatalities in Utah
What causes road fatality? Are there certain factors that contribute to higher traffic fatality rates? Is it weather patterns? Are some vehicles more likely to be involved in a traffic fatality than others? What about EMS response time? Speeding? Alcohol?
Certainly, all of these factors go into road fatalities, but how much do they really affect the rate and how can you avoid them?
Most Fatal Highway in Utah
US Route 89 in Utah has had 112 fatal crashes over the last decade. It is important to note that this highway runs through several national parks.
To determine the most dangerous highway in each US state, Geotab.com calculated a fatal crash rate that is based on the annual number of road fatalities and fatal crashes according to the National Highway Traffic Safety Administration, adjusted for the average daily traffic counts provided by the Federal Highway Administration.

Traffic Fatalities: Rural vs Urban
Most people think that most traffic fatalities happen in the city, where there are the most amount of cars on the road. However, usually, this is not the case.
Usually, there are more EMS services located in urban areas, so it is faster to reach a victim in the field at a crash site, resulting in an easier rescue.

Teenage drinking and driving is a sad statistic: but thankfully, Utah’s under-21 alcohol-impaired-driving fatality rate was under the national average.

According to this table, Utah is ranked third in the nation for DUI arrests in teens 18 and younger.
The national average for under-21 drinking and driving fatalties is 1.2 per 100,000 population. Utah’s average rate is .5 deaths per 100,000 population.
Let’s continue by talking about a little less of a depressing topic: EMS response time.
EMS Response Time
Arriving at a crash site as soon as possible is detrimental when someone’s life hangs in the balance. Seconds can sometimes mean the difference between life and death.
Check out this chart below. EMS response services are likely to get to a crash site faster if it is in an urban area; urban areas usually mean there are more hospitals, firefighters, paramedics and EMS in the area.

Response times were significantly faster in urban areas, however more fatal crashes occurred in urban areas than in rural areas in Utah.

Car Ownership in Utah
According to Data USA, the following chart displays the households in Utah distributed between a series of car ownership buckets compared to the national averages for each bucket.
The largest share of households in Utah have two cars, followed by three cars.

Commute Time in Utah
Using averages, employees in Utah have a shorter commute time (20.5 minutes) than the normal US worker (25.5 minutes). Additionally, 1.44 percent of the workforce in Utah have “super commutes” in excess of 90 minutes.
Commuter Transportation
In 2017, the most common method of travel for workers in Utah was Drove Alone, followed by those who Carpooled and those who Worked At Home.

Traffic Congestion in Utah
